Welcome to Be Here Now Mindfulness, LLC. By registering for, attending, purchasing, accessing, or participating in any services, classes, workshops, retreats, consultations, trainings, continuing education programs, psychotherapy services, online content, downloads, or materials offered through Be Here Now Mindfulness, LLC or www.beherenowmindfulness.com, you acknowledge that you have read, understood, and agree to these Terms of Use and Participant Agreement.

1. Purpose of Our Services

Be Here Now Mindfulness provides educational, contemplative, experiential, and professional training opportunities designed to support personal growth, embodiment, mindfulness, self-awareness, creativity, and professional development.

Offerings may include, but are not limited to:

  • Individual psychotherapy

  • Consultation and supervision

  • Continuing education programs

  • Workshops

  • Retreats

  • Realization Process® teachings

  • Meditation instruction

  • Somatic embodiment practices

  • Certified Kintsugi Teacher Trainings

  • Corporate trainings

  • Online courses

  • Digital downloads

  • Educational materials

Many of our programs invite participants to deepen their experience of presence, embodiment, compassion, and what Realization Process refers to as Fundamental Consciousness. Similar concepts appear across contemplative, philosophical, and spiritual traditions under different names.

Participation does not require adherence to any religious or spiritual belief system. Our programs are open to individuals of all backgrounds and beliefs.

2. Educational Nature of Services

Unless you are specifically engaged in an established psychotherapy relationship with Jennifer Finch, LPC, all classes, workshops, retreats, trainings, consultations, and educational materials are provided solely for educational, professional development, self-reflection, and personal growth purposes.

Participation does not establish a therapist-client relationship.

Educational programs are not psychotherapy, psychological treatment, psychiatric care, medical treatment, crisis intervention, or emergency services.

No diagnosis, treatment, or clinical recommendations are provided through educational offerings.

3. Medical and Mental Health Disclaimer

Our programs are not intended to diagnose, treat, cure, or prevent any physical illness, psychiatric disorder, or medical condition.

If you are experiencing physical illness, persistent emotional distress, or significant psychological symptoms, you should seek appropriate care from a licensed physician, psychologist, psychiatrist, therapist, or other qualified healthcare provider.

Participants remain solely responsible for obtaining any medical or mental health care they may require.

4. Psychological Suitability

Because many of our programs involve experiential learning, meditation, embodiment practices, emotional awareness, and reflective exercises, participants should be emotionally and psychologically stable enough to participate safely.

Our educational programs are not appropriate for individuals currently experiencing:

  • acute psychiatric crisis

  • active suicidal thoughts

  • active homicidal thoughts

  • psychosis

  • severe dissociation that significantly interferes with functioning

  • untreated substance intoxication

  • any condition requiring immediate medical or psychiatric stabilization

If, in the professional judgment of Jennifer Finch or another instructor, participation appears unsafe for you or others, Be Here Now Mindfulness reserves the right to decline or discontinue participation.

5. Physical Participation

Certain programs include movement, meditation, breathing exercises, prolonged sitting or standing, handling pottery, ceramics, adhesives, metallic powders, pigments, sharp ceramic pieces, and other hands-on activities.

You acknowledge that you are physically able to participate safely.

If you have pregnancy-related concerns, recent surgery, chronic pain, cardiovascular conditions, neurological disorders, seizures, respiratory illness, orthopedic injuries, or any other medical condition that could affect participation, you agree to consult your healthcare provider before attending.

6. Assumption of Risk

Participation in any Be Here Now Mindfulness program is voluntary. Activities that may include movement, meditation, breathing practices, emotional exploration, reflective exercises, group discussion, handling ceramic materials and tools, and other experiential learning activities.

You understand that educational and experiential programs carry inherent physical, emotional, and psychological risks, including but not limited to:

  • emotional discomfort

  • grief

  • anxiety

  • unexpected memories

  • temporary emotional activation

  • fatigue

  • dizziness

  • muscle soreness

  • allergic reactions

  • cuts or abrasions from pottery materials

  • accidental injury during workshop activities

  • aggravation of pre-existing medical or psychological conditions

You voluntarily assume all known and unknown risks associated with participation and accept full responsibility for your own physical, emotional, and psychological well-being before, during, and after participation.

7. Participant Responsibility

You remain responsible for monitoring your own physical, emotional, and psychological well-being throughout every program.

You agree to:

  • participate within your own limits

  • stop any activity that feels unsafe or beyond your present capacity

  • communicate concerns when appropriate

  • seek outside medical or psychological care if needed

Participation is always voluntary.

You may decline any exercise without penalty.

8. Release of Liability

To the fullest extent permitted under Georgia law, you release and hold harmless Be Here Now Mindfulness, LLC, Jennifer Finch, instructors, assistants, contractors, volunteers, guest presenters, employees, landlords, hosting facilities, and affiliated organizations from any and all claims, injuries, losses, damages, liabilities, expenses, or causes of action arising from your voluntary participation in any program, except where prohibited by law or resulting from gross negligence or willful misconduct.

9. Kintsugi Workshop Safety

Kintsugi workshops and Certified Kintsugi Facilitator Trainings involve ceramic materials, adhesives, pigments, metallic powders, sandpaper, sharp broken pottery, cutting tools, and other workshop supplies.

Participants agree to use all materials responsibly, follow instructor safety directions, wear any recommended protective equipment, and exercise reasonable care throughout the workshop.

Be Here Now Mindfulness is not responsible for injuries resulting from misuse of materials or failure to follow safety instructions.

10. Continuing Education Programs

Continuing Education credit is awarded only when attendance and participation requirements have been satisfied.

Completion of a training does not certify professional competence nor authorize participants to practice outside the legal scope of their professional license.

Participants remain solely responsible for complying with licensing board requirements and practicing within their scope of competence.

11. Results Disclaimer

Every participant’s experience is unique and varies considerably.

Be Here Now Mindfulness makes no guarantee regarding emotional healing, symptom reduction, professional success, certification outcomes, business results, continuing education approval by individual licensing boards, or any other specific outcome.

12. Group Confidentiality

Many of our programs involve group discussion and shared personal experiences.

Participants are expected to respect the privacy and confidentiality of others.

However, confidentiality cannot be guaranteed because it depends upon the conduct of all participants.

Each participant remains responsible for deciding what personal information they choose to disclose.

13. Photography and Media

Photographs or video recordings may occasionally be taken during workshops or trainings for educational or promotional purposes.

Participants who prefer not to appear in photographs or recordings should notify the instructor before the program begins.

14. Cancellation and Refund Policy

Private Psychotherapy, Consultation & Individual Sessions

If you need to cancel or reschedule a private session, please provide at least 48 hours’ notice.

Appointments canceled with less than 48 hours’ notice will be charged the full session fee unless the cancellation is due to illness, a family emergency, or other unforeseen circumstances at the discretion of Be Here Now Mindfulness, LLC.

If you cancel for reasons other than illness or emergency but are able to reschedule within the same calendar week, the late cancellation fee may be waived.

Workshops, Classes & Continuing Education Programs

Registration reserves your place and allows us to prepare materials, secure venues, and plan for participant attendance.

  • Cancellations made 30 or more days before the event will receive a full refund, less any nonrefundable deposit.

  • Cancellations made 15–29 days before the event may receive a credit toward a future workshop or training at the discretion of Be Here Now Mindfulness, LLC.

  • Cancellations made 14 days or fewer before the event are nonrefundable.

  • Registration may be transferred to a future offering of the same program within 12 months, subject to availability and approval by Be Here Now Mindfulness, LLC.

  • Refunds or credits due to illness, medical emergencies, or other extraordinary circumstances will be considered on a case-by-case basis.

If Be Here Now Mindfulness, LLC must cancel or reschedule a program, participants may choose either a full refund or a transfer of their registration to a future offering.

Certified Kintsugi Facilitator Training

Because the Certified Kintsugi Facilitator Training includes limited enrollment, venue expenses, continuing education administration, teacher manuals, licensing materials, and preparation specific to each participant, the following policy applies:

  • nonrefundable $150 registration deposit is required to reserve your seat.

  • Registration may be transferred to a future Certified Kintsugi Facilitator Training within 12 months if written notice is received before the training begins.

  • Cancellations received 14 days or fewer before the training are nonrefundable.

  • Requests for exceptions due to serious illness, medical emergencies, or other extraordinary circumstances will be reviewed individually.

  • If Be Here Now Mindfulness, LLC cancels the training, participants may choose either a full refund or a transfer of their registration to a future training date.

No-Show Policy

Participants who do not attend a scheduled session, workshop, or training without prior communication (“no-shows”) are not eligible for a refund or credit.

If you have questions regarding this policy or need to discuss an unforeseen circumstance, please contact me at info@beherenowmindfulness.com before your scheduled session or event whenever possible. While I strive to apply these policies consistently, I also recognize that genuine emergencies occur and will consider exceptional situations with care and fairness.

15. Emergency Situations

If, in the judgment of the instructor, a participant appears to present an imminent risk of serious harm to themselves or others, emergency services may be contacted.

Participants remain responsible for obtaining appropriate medical or psychiatric care.

16. External Resources

Our website may contain links to third-party websites or outside resources.

Be Here Now Mindfulness does not control, endorse, or assume responsibility for the content, services, or practices of any external organization.

17. Indemnification

You agree to indemnify, defend, and hold harmless Be Here Now Mindfulness, LLC, Jennifer Finch, instructors, assistants, contractors, employees, volunteers, guest presenters, licensors, and affiliates from claims, damages, liabilities, expenses, attorneys’ fees, or losses arising from your misuse of services, violation of these Terms, or unlawful conduct.

18. Force Majeure

Be Here Now Mindfulness shall not be liable for cancellation, interruption, postponement, or modification of any program due to circumstances beyond its reasonable control, including severe weather, natural disasters, public health emergencies, venue closures, instructor illness, governmental actions, internet failures, or other unforeseen events.

19. Governing Law

These Terms shall be governed by the laws of the State of Georgia.

Any legal action arising from these Terms and Conditions or participation in any Be Here Now Mindfulness program shall be brought exclusively in the state or federal courts located within the State of Georgia.

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms constitute the entire agreement between you and Be Here Now Mindfulness, LLC regarding your use of our website, services, programs, and educational offerings.

We reserve the right to revise these Terms at any time. Continued participation in our programs or continued use of our website constitutes acceptance of the updated Terms.
